Today’s lecture was presented in part by Charles P. SabatinoJD, Director American Bar Association Commission on Law and Aging. Because of flight delays, Mr. Sabatino only spoke for the second half of the session. Prof. Gittler followed Mr. Sabatino’s slides and spoke for the first half of class. Mr. Sabatino’s materials discussed the role of a lawyer in dealing with clients with diminished capacity. Mr. Sabatino emphasized the need for an attorney to determine the capacity of clients both to contract with the attorney and to complete the legal transaction. Mr. Sabatino proposes that each attorney should have a regular system for assessing a client’s capacity and documenting the attorney’s impressions. He discussed various levels of capacity required for different transactions and led the class through his assessment system using hypothetical clients.
